Privacy Policy

This Privacy Policy explains how Yakity, LLC, doing business as Yakity-yak (“Yakity-yak,” “we,” “us,” or “our”), collects, uses, and shares information when you use the Yakity-yak iPhone app, the Yakity-yak Mac app, the website at yakity.app, and when you buy a Yak-01 or a subscription from us (together, the “Service”). By using the Service, you agree to this Privacy Policy and to our Terms of Service.

1. Information we collect and how it is processed

Yakity-yak is designed so that your dictation stays on your own devices. We do not operate a server that receives your audio, transcripts, notes, or settings, and we do not have access to them unless you choose to send them to us.

Audio and transcription

The iPhone app uses your iPhone’s built-in microphone only when you start a recording, and, if you turn on microphone standby, to keep the microphone ready for the period you choose. Audio captured during standby is discarded and is not saved, transcribed, or sent. Speech is transcribed on your iPhone using Apple’s speech recognition with on-device processing required, so your audio is not sent to us, to your Mac, or to Apple’s servers for transcription. Apple’s handling of its on-device features is governed by Apple’s privacy policy.

A recording is kept on your iPhone until your Mac confirms it received the transcript, so a failed delivery can be retried, and is then deleted. A recording that is never delivered is deleted when its history entry expires or when you delete the related note.

Text sent between your devices

Transcripts, notes, writing settings, Dictionary and snippet entries, and messages you exchange with apps on your Mac travel directly between your iPhone and the Mac you paired with it. They are sent over your local network or, if you set one up, over a private networking service you use to connect your devices. Every message is encrypted with a key created when you pair the devices and stored in each device’s keychain.

Content on your Mac

With the Accessibility permission you grant, the Mac app reads the text field you are typing in, any text you have highlighted, and text visible in the active window. It uses this to place your words correctly, to rewrite highlighted text when you ask it to, and to recognize names and terms so they are spelled correctly. This happens on your Mac. Recognized terms and highlighted text may be included in AI processing requests described below.

AI text processing

The Mac app can clean up and edit your words with a third-party AI processing provider that you connect using your own account and API key. When connected, the Mac app sends the text being processed over an encrypted connection to that provider. This can include your transcript, your Dictionary spellings, terms recognized in the active window, and, when you edit highlighted text, that text and your spoken instructions. The provider processes this text under your account and its own terms and privacy policy. Audio is never sent. If no provider is connected or a request fails, the Mac app uses Apple’s on-device model where your Mac supports it. Your API key is stored in your Mac’s keychain and is not sent to us.

Agent alerts

If you turn on agent alerts, the Mac app saves an encrypted notice to your own private iCloud database, and Apple delivers a notification to your iPhone. The notice is encrypted with your pairing key before it leaves your Mac, so its contents cannot be read by us or by Apple.

Camera

The iPhone app uses the camera only to scan the pairing code shown by your Mac. Camera images are not saved or sent.

Purchases and orders

Subscriptions are sold through the Apple App Store. Apple processes your payment, and we do not receive your payment card details. We may receive information from Apple about your subscription, such as its status and transaction identifiers, so we can provide the features you paid for.

When you order a Yak-01, we collect your name, email address, shipping address, order details, and, if you provide it, a phone number. Payments are handled by our payment processors, and we do not receive or store your full payment card number.

Communications

When you contact us, we receive your email address and whatever you include in your message, such as a diagnostics log you choose to attach. Diagnostics logs in the iPhone app stay on your iPhone unless you copy or send them.

Device and technical information

The apps do not include advertising or third-party analytics. If you choose to share analytics with app developers in your Apple device settings, Apple may provide us with crash reports and usage statistics. When you visit our website, our hosting providers may automatically process technical information, such as your IP address and browser type, to deliver and secure the site. We do not track you across apps or websites owned by other companies.

2. How we use information

We use the information we receive to provide, maintain, and improve the Service; to process subscriptions, orders, shipments, and returns; to respond to you and provide support; to send you service and transactional messages; to detect and prevent fraud, abuse, and security problems; to enforce our Terms of Service; and to comply with legal obligations.

3. How we share information

We do not sell your personal information, and we do not share it for cross-context behavioral advertising. We share information only as follows:

  • Service providers. With companies that work on our behalf, such as hosting and cloud providers, payment processors, fulfillment and shipping carriers, and email and customer support providers, who may use it only to provide services to us.
  • Apple. Apple processes App Store purchases, iCloud storage, and notification delivery under its own terms and privacy policy.
  • Services you connect. Services you choose to connect, such as an AI processing provider or a private networking service, receive information under your own account with them. Their terms and privacy policies govern that information.
  • Legal and safety. When we believe disclosure is required by law or legal process, or is necessary to protect the rights, property, or safety of Yakity-yak, our users, or others.
  • Business transfers. In connection with a merger, acquisition, financing, sale of assets, or similar transaction, or in bankruptcy.
  • With your consent or at your direction.

4. Retention

On your devices, dictation history is removed automatically after 24 hours, or the next time the app runs after that if it is closed. Notes stay on your iPhone until you delete them. Deleting an app removes its data from that device, and resetting pairing invalidates the previous pairing key.

We keep order, purchase, and support records for as long as needed to provide the Service, resolve disputes, enforce our agreements, and meet legal, tax, and accounting requirements.

5. Security

We use reasonable safeguards designed to protect information, including encryption between your paired devices. No method of transmission or storage is completely secure, and we cannot guarantee the security of any information.

6. Your choices and rights

You can turn off microphone, speech recognition, camera, local network, notification, and Accessibility access in your device settings, although parts of the Service will stop working. You can disconnect an AI processing provider by removing your API key in the Mac app, turn off agent alerts, delete notes and history, and delete the apps at any time.

Depending on where you live, you may have the right to request access to, correction of, or deletion of personal information we hold about you, and to appeal our decision on your request. To make a request, contact us using the details below. We may need to verify your identity before we respond, and we will not discriminate against you for exercising these rights.

7. Children

The Service is not directed to children under 13, and we do not knowingly collect personal information from them. If you believe a child under 13 has given us personal information, contact us and we will delete it.

8. International users

We are based in the United States. Information we receive may be processed in the United States and other countries where we or our service providers operate, which may have data protection laws different from those where you live.

9. Changes to this policy

We may update this Privacy Policy at any time. We will post the updated version on this page with a new effective date. Your continued use of the Service after an update means you accept the updated policy.
